One defendant changes plea in Fallon County assault case, another expected to change plea in November

One of two defendants in an assault case currently in Sixteenth Judicial District Court in Fallon County has changed his plea while the other defendant is expected to change his plea next month. The defendants, Tucker Tooke and Turner Tooke, were both charged with counts of assault with a weapon, a felony, late last year.

A trial for both defendants was scheduled to take place Oct. 17, however that trial has now been vacated.

Tucker Tooke entered a change of plea on Sept. 26, pleading guilty to one count of assault with a weapon with another count being dismissed.

A change of plea hearing for Turner Tooke is scheduled to take place on Nov. 7 at 1 p.m. He has been charged with just one count of assault with a weapon.

The charges against both defendants stem from an incident on or about Nov. 9, 2022 when two juvenile female victims reported being branded without their consent at a party in Fallon County the night of Nov. 5. Both victims were interviewed by the Fallon County Sheriff's Office and reported falling asleep at the party due to being intoxicated, finding out they had been branded on the leg when they woke up.

Both victims reported being told by others at the party that they had been branded by Tucker. In interviews with the defendants on Nov. 18, each admitted to branding one of the victims while Tucker reportedly admitted to branding both of them, according to court documents.

A sentencing hearing for Tucker has been scheduled for Nov. 22 at 1:30 p.m.
